MIL APPLICATION SOFTWARE - INFORMATION POLICY

- 1 The MIL Application Software
- 1.1 This Information Policy applies to your use of the MIL application software
(MAS) provided by Mine International Limited (MIL
or we or us), which you have chosen to download
and install. Where the MAS has been customised with a third party's branding, that
third party (the Provider) has collaborated with MIL and MIL has
customised and branded the MAS for the Provider.
- 1.2 The MAS has been developed to provide end users with a more relevant and customised
internet browsing experience and the information that we learn from end users helps
us to continually improve their browsing experience. MIL and the Provider use the
information to display to end users details of links, websites, offers, services,
promotions or other content which may be of interest to them.
- 1.3 MIL is committed to protecting and respecting your privacy. We understand that
you are concerned as to how any information about you is collected and used and
we realise that you trust us to do this carefully and sensibly. This policy (together
with our End User Licence Agreement (EULA) (available online at:
http://www.discovermine.com/terms/eula)
sets out how the data or information we collect from end users, or that they provide
to us through their use of the MAS, will be used by us. Please read the following
carefully to understand our views and practices regarding end user data and information
and how we will treat it.
- 2 What information will the MAS collect?
- 2.1 The MAS is designed to avoid the collection of any personal data or personally
identifiable information about you, i.e. information which can be directly associated
with you, such as a name or email address.
- 2.2 The MAS uses only non-personally identifiable data such as end user browsing
preferences and favourites. This information is stored by MIL and used to understand
broad categories of end users' interests and browsing preferences. This information
is not and cannot be used to specifically identify a specific person or entity.
- 3 How is the MAS designed not to collect personally identifiable information?
- The MAS is designed not to collect Personally Identifiable Data. For example, MIL
does not require any personal information from end users to enable them to download
and install the MAS. Any information collected about an end user's preferences is
associated with an anonymous key and so it is not personally identifiable data.
- 4 What information is collected via the MAS?
- 4.1 The types of information collected by the MAS may include:
- 4.1.1 Information on the way that end users have customised the MAS to reflect their
web browsing preferences.
- 4.1.2 Information in the way that end users use the MAS to browse the internet including
(but not limited to) where available, IP addresses, operating systems and browser
types, traffic data, location data, other communication data, details of the publishers
that are most popular with end users, click stream information, areas or categories
of interest which end users most commonly browse, the RSS feeds that end users select,
bookmarks that end users select, the URLs that end users use for system administration
and to report aggregate information to the Provider. This information is statistical
data about our end users' browsing actions and patterns, and does not identify any
individual.
- 4.1.3 For the same reason, we may obtain information about end users' internet usage
as it relates to the MAS by using a cookie file which is stored on the hard drive
of end users' computers. Cookies contain information that is transferred to a user's
computer's hard drive. They help us to improve the MAS and to deliver a better and
more personalised service. They enable us to:
- estimate our usage pattern; and
- store information about end user preferences, and so allow us to tailor the MAS
according to end users' interests.
- 4.2 You may refuse to accept cookies by activating the setting on your browser which
allows you to refuse the setting of cookies. However, if you select this setting
you may be unable to access the MAS. Unless you have adjusted your browser setting
so that it will refuse cookies, the MAS will issue cookies when you install the
MAS.
- 5 How is the information which we collect via the MAS used?
- 5.1 The information that the MAS collects allows MIL to define usage patterns and
the online behaviour of end users of the MAS. We may use such information, or permit
the Provider to use such information, to provide end users with targeted information
about merchandise, goods, services, offers, promotions or other advertisements which
may be of interest to them via the display of scrolling messages on the MAS' newsreader
and/or the customised content and/or layout of the MAS according to end user behaviours
and preferences.
- 5.2 We reserve the right to change our information practices from time to time and
to use information for new, previously unanticipated uses. If our information practices
change, we will post the policy changes on the MAS and to our Web site to notify
you of these changes, which will only apply to data collected from the time of the
policy change forward. If you are concerned about how your information is used,
please be sure to check the link to this Information Policy on our web site periodically.
- 6 Where is the information we collect stored?
- 6.1 The data that we collect from end users may be transferred to, and stored at,
a destination outside the European Economic Area (EEA). By submitting
information through your use of the MAS you agree to this transfer, storing or processing.
- 7 Who do we disclose end user information to?
- 7.1 We may disclose aggregated end user information to any member of the MIL group
of companies.
- 7.2 We may disclose aggregated end user information to third parties:
- 7.2.1 In the event that we sell or buy any business or assets, in which case we
may disclose aggregated end user information to the prospective seller or buyer
of such business or assets.
- 7.2.2 If we are under a duty to disclose or share end user information in order
to comply with any legal obligation or request of governmental authorities conducting
an investigation, to verify or enforce compliance with the policies governing the
MAS and applicable laws or to protect against misuse or unauthorized use of the
MAS.
- 7.2.3 If we are under a duty to disclose or share your information in order to enforce
or apply the EULA between you and MIL (http://www.discovermine.com/terms/eula)
and other agreements; or to protect the rights, property, or safety of MIL, our
customers, or others. This includes exchanging information with other companies
and organisations for the purposes of fraud protection.
- 7.2.4 We may disclose or share aggregated end user information with any successor
entity in connection with a corporate merger, consolidation, sale of assets or other
corporate change respecting the MAS.
- 8 What about my use of links via the MAS? The MAS contains various
directories of links to the website of the Provider and other third parties. If
you follow a link to any of these websites, please note that these websites have
their own privacy and/or information policies and that we do not accept any responsibility
or liability for these policies. Please check these policies before you submit any
information (particularly personal data) to these websites.
